Purpose and Scope

This website is exclusively for private customers and end consumers. Sales are made within the limits of available stock. The terms and conditions apply to the purchase of products from the operator of this website and replace all previous agreements. The terms and conditions are written in German, which is the only binding version and takes precedence over any other language version. For the purchase, the terms and conditions valid at the time of the contract conclusion are decisive.

    Product features

Patterns and colors on the product photos may differ from the original. Deviations arise due to technical limitations in color reproduction on the end devices and the degree of exposure during the capture and editing of the photo. The operator cannot be held liable for these discrepancies.

    Availability of products

The products displayed on the website are shown according to their availability. Stock errors may occur. Consequently, availability is not guaranteed until the order confirmation is sent. In individual cases, errors may occur, especially when multiple orders for the same product are placed between one system synchronization and the next. Customers have the option to join a waiting list for products that are not available at that time. You will receive an email when a product is back in stock.

User account

Every order on this website is placed through a user account. Orders with a guest account are not possible.

Order confirmation

Upon placing an order and agreeing to the terms and conditions, an order confirmation will be sent to the email address associated with the user account. The order confirmation acknowledges the receipt of the order in summary and does not yet constitute a sales agreement. Changes to the order by the orderers can be made until the order confirmation.

Order confirmation

Subsequently, the order is processed by the website operator. The availability and quality of the ordered goods are checked and then confirmed via email to the user account. The order confirmation is considered acceptance of the contract by the website operator.  Changes to the order can no longer be made.

Right of reservation

The website operator reserves the right to refuse an order from a customer if a contentious business relationship preceded it, if the terms and conditions were violated, if fraudulent intentions were suspected, or for other legitimate reasons.

Shipping and Tracking

The customers will receive a notification via email when the goods have been delivered. Between the receipt of the order confirmation and shipping, there are usually no more than 72 hours on business days. For tracking, a tracking number will be provided. Only the items listed in the order confirmation will be charged.

    Prices

Currencies

The prices are listed in Euro, AUD, GBP, USD. The Euro is solely binding throughout the entire ordering process. The conversion from Euro to other currencies is done automatically by a currency converter used on the website.

Taxes and duties

All prices include taxes. Customs duties for deliveries outside the European Union are charged in the recipient country and are to be borne by the orderer.

Change of Prices

The website operator reserves the right to change the prices of the products and delivery costs without prior notice. The products and delivery costs will be calculated at the price displayed on the operator's website at the time of the order.

    Payment

Payment can be made by credit card (Visa, Master) or PayPal. The transaction is processed through the secure websites of the banking service providers. The payment data of the customers is transmitted in encrypted form and is not stored by the website operator.

    Retention of title

The delivered products remain the property of the website operator until full payment is received.

    Warranty

The statutory warranty rights apply. Should the delivered products exhibit defects or damages, the orderers or recipients must promptly file a complaint with the website operator, provided this is desired by the orderers. However, a failure to do so will not have any consequences for statutory claims. Complaints should be directed to the website operator via email.

    Acceptance of the delivered products

Delivery person

The purchaser or their authorized representative is responsible for inspecting the goods and packaging for errors or defects upon receipt before signing for the delivery. Reservations must be communicated to the delivery person or the transport company and noted in handwriting on the delivery slip.

Liability for Delivery

The website operator is not liable for the final delivery if it could not be delivered due to an incorrect address, absence of the orderers, or refusal of the package by the orderers/recipients. If an incorrect address or refusal leads to another delivery attempt, the website operator is entitled to charge the customers the corresponding costs. The general delivery terms of the delivery company apply. If delivery could not be made and no further delivery attempts were made, the website operator will not make a new delivery.

    Revocation

Deadlines

Within 14 days, the customers have the right to withdraw from the contract without giving any reasons. With the acceptance and possession of the products by the buyers. To meet the deadline, the notification of the exercise of the right of withdrawal must be made before the withdrawal period expires. The notification for exercising the right of withdrawal must be sent to the website operator via email, to the email address specified in the invoice, or through the customer form on the operator's website, or via the QR code that may have been included with the delivery. In any case, however, directly to the website operator.

Exclusion

The right of withdrawal does not apply to contracts for the delivery of sealed goods that are not suitable for return for health or hygiene reasons if the seal has been removed or damaged after delivery.

    Return of the goods

To exercise the right of return, the orderers must notify the website operator of the return within 14 days after receiving and accepting the goods. To do this, the QR code included in the delivery package is used. Scan the QR code and follow the instructions on the operator's website.

The website operator will refund the purchasers, and in the event of the purchasers properly exercising their rights, the price of the returned products within 10 days after receiving the returned products. The refund will be made using the payment method that was used for the order.

Packages returned after the statutory period will not be accepted and will be sent back at the sender's expense.

Reimbursement of return and delivery costs

The costs of the return are borne by the orderers/customers. Shipping costs paid at the time of order will not be refunded upon return. In the case of an exchange, shipping costs will be charged again.

    Force majeure

In the event of force majeure, if the website operator is hindered or prevented from fulfilling their obligations, the website operator is exempt from liability for non-fulfillment of their obligations but is not exempt from the obligation to make all efforts to fulfill them.

    Links, references, and content from third parties

Insofar as additional information is made accessible through links to other websites, the website operator points out that there is no content control and no influence on the content of third-party sites, as well as on their compliance with legal regulations. The website operator expressly distances itself from the content on third-party websites and all linked content therein.

    Validity of the Terms and Conditions

The terms and conditions are valid until a new version is published on the operator's website.

    Applicable law

Portuguese law applies, excluding the UN Sales Convention. The mandatory application of foreign consumer law for orders placed abroad remains unaffected.
